Terms and conditions

1. About the website and operator

These Terms and Conditions (“Terms”) govern access to and use of the website available at https://yachtkid.ro (“Site”), as well as the submission of requests through forms, contact details, and features available on the Site.

The Site presents the YACHT KID residential complex and commercial spaces and is managed by the operator identified below (“Operator”).

Within the meaning of these Terms, “User” means any person accessing the Site, consulting the published information, or sending a request to the Operator.

2. Acceptance and scope

By accessing or using the Site, the User confirms that they have read these Terms and will use the Site in accordance with them and applicable legislation. If they do not agree with the Terms, the User must stop using the Site.

The Terms apply exclusively to the use of the Site and interactions initiated through it. They do not replace or modify documents signed subsequently regarding the reservation, promise of sale, sale, lease, fit-out, or management of a property. In the event of a discrepancy, the signed contractual document between the parties prevails for the legal relationship it regulates.

The forms and information on the Site are intended for individuals with necessary legal capacity. Persons under 18 years of age may only use the Site with the involvement of a legal representative.

3. Role of the Site. The Site does not execute real estate transactions

The Site serves an informational and promotional purpose. It allows consulting information about the project, apartment types, commercial spaces, features, technologies, facilities, starting or indicative prices, and contact details.

No information published on the Site constitutes, in itself, an irrevocable offer to contract, a promise of sale, a reservation, a guarantee regarding unit availability, or a personalized investment recommendation. A transaction or reservation produces effects only based on a separate document, accepted and signed in the legally required form by authorized persons.

Clicking a button such as “Request offer”, “Contact us”, or “Schedule viewing”, filling out a form, or sending a message via email or WhatsApp represents only a request for contact. These actions do not block a unit, do not grant priority over other potential buyers, and do not oblige the Operator to conclude a contract.

4. Project information, surfaces, and visual materials

The Operator aims to keep published information clear, correct, and updated. However, the Site may contain material errors, temporarily outdated information, or differences resulting from project developments, documentation updates, or digital representation limitations.

Renderings, photos, tours, sketches, plans, animations, furniture, decor, vegetation, views, and simulations are for presentation purposes unless expressly stated otherwise in a contractual document. Colors and proportions may vary depending on screen, perspective, or visual processing.

Surfaces, layouts, dimensions, features, finishes, orientation, floor level, terraces, balconies, and other characteristics must be verified in the individual offer, technical documentation, cadastral documentation, and relevant contract annexes. The documents signed for the selected unit establish the assumed legal and technical specifications.

The Operator may update presentation information and materials to reflect current status, without affecting rights already acquired through signed contracts and without limiting mandatory legal obligations.

5. Availability, prices, VAT, and costs

Unit availability can change rapidly, including as a result of simultaneous discussions with multiple potential buyers. References such as “available”, “last apartments”, or stock information describe the situation known at the time of update and must be reconfirmed directly with the Operator.

Prices displayed as “starting from” represent a starting threshold for the indicated category and do not imply that all units are available at that level. Currently, the Site indicates VAT separately using phrasing like “+ VAT”. Final value, VAT rate and treatment, currency, applicable exchange rate, potential options, parking spots, storage units, additional finishes, services, and payment terms are established in the individual offer and signed contract.

The Site does not process payments for purchasing or reserving properties. The User must not transmit card data, banking passwords, or other credentials through general contact forms.

6. Requests, offers, and scheduling viewings

To request information or a viewing, the User must provide truthful, accurate, current, and sufficient data to be contacted. The User is responsible for the content of sent messages and for the right to use entered contact details.

Submitting a request does not guarantee confirmation of the chosen date, unit availability, or issuance of an offer within a specific timeframe. A viewing is considered scheduled only after confirmation by an Operator representative.

An individual offer may have its own validity period, conditions, and assumptions. The User must read them fully. Phone discussions, messages, and preliminary materials do not replace the written form required for property-related legal acts.

7. Maintenance and investment information

Any estimate regarding maintenance costs, consumption, energy efficiency, or savings is formulated based on information and assumptions available at the time of publication. Actual costs may vary depending on consumption, surface area, provider tariffs, services, homeowners’ association decisions, taxes, inflation, usage patterns, and other circumstances beyond the Operator’s control.

References to investment value, demand growth, yield, passive income, profitability, or property value appreciation are general marketing statements. They do not constitute financial, tax, or legal advice and do not guarantee a future result. Any purchase decision must be based on the User’s own analysis and, if necessary, independent advice.

Nothing in this section limits a guarantee or obligation expressly assumed by the Operator in a signed contract, nor mandatory rights recognized by law.

8. Rules of use

The User will use the Site only for legitimate purposes and in a manner that does not compromise operation, security, or rights of others. Prohibited actions include, among others: unauthorized system access; introducing malicious code; unauthorized vulnerability testing; overloading infrastructure; bypassing security measures; unauthorized use of third-party data; transmitting illegal, misleading, abusive, or harmful content; as well as automated bulk extraction of content for commercial purposes without written consent.

The Operator may temporarily restrict access to the Site or certain features when reasonable indications of abuse, security risk, or violation of law or these Terms exist.

9. Intellectual property rights

The Site and its content, including the name YACHT KID, text, graphic elements, photos, videos, renderings, plans, interface, databases, technical materials, and content selection or organization, are protected by intellectual property laws and belong to the Operator or are used under rights/licenses.

The User may consult and keep copies of materials strictly for personal, non-commercial information. Reproduction, publication, modification, distribution, commercial reuse, creating derivative works, or removing ownership notices are prohibited without prior written consent from the rights holder, except where expressly permitted by law.

10. Personal data and cookies

Processing of personal data sent via forms, email, phone, WhatsApp, or other channels is described in the Privacy Policy. Cookie usage and similar technologies are managed through the consent mechanism and dedicated information available on the Site.

The Privacy Policy can be consulted at: https://yachtkid.ro/politica-de-confidentialitate/

The User should not submit special categories of data, identity documents, banking details, or other unnecessary information through general forms unless clear instructions and an appropriate channel are provided by the Operator.

11. Links, platforms, and third-party operators

The Site may include links or integrations to third-party services, such as social networks, WhatsApp, maps, video platforms, analytics tools, or authority websites. These services are controlled by third parties and may be subject to their own terms and policies. The Operator does not control and does not guarantee their availability, security, or content.

References to shops, cafes, salons, clinics, studios, or other businesses present in the YACHT KID community describe the status reported at the time of publication. Their activity, schedule, offerings, and services are managed by the respective operators unless expressly mentioned otherwise.

12. Availability and security of the Site

The Operator aims to maintain the Site in a functional and secure state, but cannot guarantee uninterrupted access, absence of errors, or compatibility with any device or browser. Access may be suspended for maintenance, updates, security, technical incidents, or causes beyond reasonable Operator control.

The User is responsible for protecting their own device, connection, and software. Any suspicious message requesting payments, passwords, or banking data on behalf of YACHT KID should be verified through official contact details published on the Site.

13. Liability

To the maximum extent permitted by law, the Operator is not liable for damages caused exclusively by: using the Site contrary to these Terms; decisions made solely based on general presentation materials without verifying applicable documents; temporary Site unavailability; actions of third parties; or provision of incorrect data by the User.

The Operator does not exclude or limit liability that cannot be legally excluded, including mandatory consumer rights and liability for its own acts in cases provided by law. No provision of these Terms waives obligations expressly assumed through a signed contract.

14. Complaints, grievances, and alternative dispute resolution

For questions or complaints regarding the Site, the User may contact the Operator at contact@yachtkid.ro or +40 739 085 331. For effective resolution, the message should describe the situation and include contact details and relevant documents without sending excessive information.

Consumers may use mechanisms provided by the National Authority for Consumer Protection (ANPC), including the alternative dispute resolution (ADR/SAL) procedure, under the law.

ANPC Information: https://anpc.ro/

National ADR/SAL Platform: https://reclamatiisal.anpc.ro/

Use of an alternative procedure does not prevent access to competent courts. The availability and conditions of ANPC procedures are established by the competent authority and subject to change.

15. Modification of Terms

The Operator may update these Terms to reflect changes to the Site, business, or legal framework. The updated version will be published on this page and will indicate the last update date. Changes apply to future use of the Site and do not retroactively modify already signed contracts.

16. Applicable law and disputes

These Terms are governed by Romanian law. Any dispute will be resolved amicably as a priority. If amicable resolution is not possible, the dispute will be submitted to competent courts under the law, without restricting mandatory procedural consumer rights.

17. Final provisions and contact

If any provision of these Terms becomes void, unlawful, or unenforceable, remaining provisions remain applicable to the extent permitted by law. Failure to immediately exercise a right does not constitute a waiver of that right.

If the Terms are published in another language, the Romanian language version prevails to the extent permitted by law.
